Litigation and dispute resolution, with a focus on commercial and corporate disputes and insolvencies, and broad experience conducting large scale, complex and multi-party litigation. His experience includes contract disputes, Corporations Act matters, claims against trustees/responsible entities, and misleading or deceptive conduct and professional negligence claims.

  • Acting for BlueScope Steel (AIS) in NSW Supreme Court proceedings against South32, seeking declarations and damages for alleged breaches of a 30 year coal supply contract
  • Acting for Bruce Gordon’s Birketu in NSW Supreme Court proceedings in connection with the voluntary administration of then ASX-listed Ten Network, in the context of shareholder guarantees for, and ultimately a joint venture bid (by way of DOCA proposal) with Lachlan Murdoch’s Illyria for control of, Ten Network
  • Acting for WIN Corporation in NSW Supreme Court proceedings in respect of its regional affiliation agreement with Nine Entertainment Co. concerning whether live-streaming of television content constituted “broadcasting” within the meaning of the agreement (WIN Corporation Pty Ltd Nine Network Australia Pty Limited [2016] NSWSC 523)
  • Acting for interests related to Australian Container Freight Services seeking an injunction in the NSW Supreme Court against the $9 billion Qube/Brookfield break-up scheme of arrangement proposed by ASX-listed Asciano
  • Acting for Hall Chadwick as the liquidators of Equititrust in pursuing claims in the Federal Court of Australia against the company, its directors and the auditors of the Equititrust Income Fund managed investment scheme
  • Acting for shareholders of Nexus Energy in Supreme Court proceedings opposing the transfer their shares to Seven Group Holdings for no consideration in the voluntary administration of the company (Re Nexus Energy Ltd (subject to deed of company arrangement) [2014] NSWSC 1910)
  • Acting for KordaMentha as the trustee of the LM Managed Performance Fund in litigation against the liquidators of the former trustee and against trust creditors, in court applications relating to the management of the trust, and to provide general advice
  • Acting for EY as the liquidators of Tamaya Resources in a claim against its directors and auditors arising out of the acquisition of gold mining assets in Armenia and the subsequent development of those assets
  • Acting for RACQ Insurance in relation to the January 2011 flood events, including claims management, policy interpretation, internal and external dispute resolution and regulatory advisory work; representing RACQ Insurance at the 2011 Queensland Floods Commission of Inquiry
